In a significant development in the Rs 12,000-crore Punjab National Bank (PNB) fraud case, the Indian government has provided detailed assurances to Belgian authorities regarding the detention conditions of businessman Mehul Choksi, should he be extradited to India. This move comes amid concerns over human rights and prison standards during the ongoing extradition proceedings.

The Union Ministry of Home Affairs (MHA), in consultation with the Maharashtra government and prison authorities, has outlined a comprehensive framework to guarantee that Choksi’s detention would meet international standards. The assurances were submitted to Belgium’s Ministry of Justice and competent judicial authorities, emphasizing humane treatment, medical care, and adequate living conditions.

Designated Facility and Living Conditions

Choksi is expected to be lodged in Barrack No. 12 at Arthur Road Jail, Mumbai, which accommodates non-violent prisoners such as economic offenders. The barrack has a maximum capacity of six inmates and is currently under-occupied.

Key features of the detention include:

  • Personal space: A minimum of three square metres per detainee, excluding furniture.

  • Sleeping arrangements: Cotton mats (mattresses), pillows, bed sheets, and blankets. Metal or wooden beds may be provided on medical advice.

  • Ventilation and sanitation: Grilled windows, ceiling fans, attached toilet and bathroom, and continuous municipal water supply.

  • Recreation: Daily outdoor exercise, indoor games such as board games and casual badminton, yoga, meditation, and access to a library.

  • Food: Three meals a day with accommodations for special dietary requirements; jail canteen and provisions such as fruits and snacks are available.

Medical Care

Medical facilities are available round-the-clock, including:

  • Six medical officers, nursing staff, pharmacists, and laboratory support.

  • A 20-bed prison hospital equipped with ICU capability and emergency referrals to Sir JJ Group of Hospitals nearby.

  • Provision for private medical care at the detainee’s expense.

  • Special consideration for Choksi’s pre-existing medical conditions, with necessary equipment and therapies provided free of cost.

Legal Access and Oversight

Choksi will have:

  • Daily access to lawyers (excluding Sundays and public holidays).

  • Weekly visits from immediate family members.

  • Access to telephone and video-conferencing facilities.

Oversight mechanisms include monitoring by prison authorities, inspections by National and State Human Rights Commissions, and judicial supervision. Prison staff receive extensive training, including yoga and meditation programs, to ensure restraint and humane treatment.

Context and Next Steps

These assurances aim to address human rights concerns under Article 3 of the European Convention on Human Rights, which prohibits torture or inhuman treatment. Belgian courts, including the Chambers of Indictment in Antwerp, will evaluate these guarantees as part of the extradition proceedings. If the assurances are deemed sufficient and legal conditions for extradition are met, Mehul Choksi may be surrendered to India to face trial in the PNB fraud case.

The detailed framework underscores India’s commitment to ensuring that high-profile detainees are treated humanely while upholding international standards in custodial care.
